Terms of Service

Last updated: September 18, 2026

These Terms of Service ("Terms") are a contract between you and Sunny Vision Investments LLC, doing business as PocketProxy ("PocketProxy", "we", "us"). They cover the website at pocketproxy.io, the customer dashboard, the API, the PocketProxy Android app, the marketplace, and every proxy, VPN and device service we provide (together, the "Service").

You accept these Terms when you create an account, by email or with Google, when you sign in, when you claim or buy anything, and whenever you use the Service. If you don't agree, don't use the Service. If you're using the Service for a company, you're agreeing on its behalf and you confirm you're allowed to.

THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER (SECTION 22). THEY CHANGE HOW DISPUTES BETWEEN YOU AND POCKETPROXY ARE RESOLVED. READ THAT SECTION. YOU CAN OPT OUT OF ARBITRATION WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS.

Our Privacy Policy explains what we collect and what we log. It's part of these Terms.

1. Who Can Use the Service

You must be at least 18 years old and able to enter a binding contract. You must not be barred from using the Service under sanctions or export laws (Section 23). You must give us accurate information and keep it current.

2. Your Account

You're responsible for everything done with your account. Your password, your API keys, your proxy usernames and passwords, and the IP addresses you whitelist are all credentials: keep them secret, and tell us straight away at [email protected] if you think any of them has leaked.

One account per person or company unless we agree otherwise. We may refuse, suspend or close accounts as described in Sections 5 and 21.

3. What the Service Is

PocketProxy is a platform for running Android phones as mobile proxies. It works two ways:

  • Your own phones. You pair Android devices you own or control, with SIM cards you're entitled to use, and we provide the relays, the dashboard and the connection types (HTTP, SOCKS5, OpenVPN and WireGuard) to reach them.
  • Rented phones. The marketplace lets you rent proxy access to phones that PocketProxy operates, by the day, week or month. Section 8 covers rentals.

The phones are consumer devices on public mobile networks. IP addresses change, carriers change their networks, phones go offline and reboot. We don't promise any particular IP address, carrier, location, speed or uptime, and we don't promise that any website or online service will accept traffic from a mobile IP.

4. Acceptable Use

Use the Service only for lawful purposes. You must not use it to:

  • Break any law, or help anyone else break one.
  • Infringe copyright, trademarks or other intellectual property, for example by downloading or distributing pirated films, music, software or games. Our Copyright Policy explains how we handle notices.
  • Commit fraud of any kind, including advertising, click, affiliate, payment, refund and identity fraud.
  • Access systems you're not authorised to access, including by credential stuffing, password guessing, exploiting vulnerabilities, port scanning or denial of service.
  • Create accounts, votes, reviews, followers or engagement in bulk by deception, or evade a ban, block or restriction a site has placed on you.
  • Store, share or reach child sexual abuse material, or any sexual content involving minors. We report this to the authorities.
  • Harass, stalk, threaten or dox anyone.
  • Send spam, phishing, malware or unsolicited bulk messages of any kind, by any protocol.
  • Collect personal data without a lawful basis.
  • Buy tickets, goods or services with automated tools where the law prohibits it, for example under the U.S. BOTS Act.
  • Violate your mobile carrier's terms, or damage, overload or interfere with our network or anyone else's.
  • Reverse engineer, tamper with, or work around the Service's security, limits or billing.
  • Use stolen phones, stolen SIM cards, or service obtained by fraud.
  • Use the Service where sanctions or export laws prohibit it (Section 23).

You're responsible for everything that goes through your ports, keys and devices, whether you sent it or someone you gave access to did.

5. Enforcement and Abuse Complaints

We run a proxy network, so we receive abuse complaints and legal requests. To keep the network usable for everyone, we may at any time and without notice:

  • Block destinations, ports or protocols. Outbound mail ports are blocked network-wide, for example.
  • Apply usage limits, rate limits or bandwidth caps to a port, a device or an account.
  • Suspend or disable a port, device or account that we reasonably believe is breaking these Terms or is the subject of a credible complaint.
  • Investigate, and cooperate with law enforcement, carriers and the people affected.

We keep connection records, described in the Privacy Policy, and we produce them in response to a subpoena, court order or other valid legal process. Suspension for breach doesn't entitle you to a refund. To report abuse of the Service, email [email protected]. Copyright notices follow the process on our Copyright Policy page.

6. Operators and Resellers

If you run your own phones on the Service, you confirm and agree that:

  • You own the devices, or have the owner's permission, and every SIM card is yours to use.
  • You comply with your carrier's terms and with telecommunications law wherever the phones are.
  • You may resell access to your devices. If you do, you're the provider to your customers: you set their terms, you handle their support, and you're responsible for what they send as if you'd sent it yourself.
  • You keep whatever records the law requires of a provider in your jurisdiction.

We provide the platform. We're not a party to your agreements with your customers.

7. Device Sharing and Remote Control

You can share a device you own with another account and choose which permissions that account gets. You're responsible for who you share with and what you grant, and you can change or revoke any permission at any time.

One permission, Remote Control, is much broader than the others. It lets the account you share with view and operate the physical phone itself, including its screen, apps, messages and any accounts signed in on it. It's not limited to proxy settings. By enabling Remote Control you confirm that:

  • You understand the recipient can see and control the phone and any data on it.
  • You have the authority to grant that access, including from anyone else who uses the phone or whose personal data is on it.
  • Actions the recipient takes are attributed to your account, count toward your usage, and are billed to you.
  • You remain responsible for those actions as if you'd taken them yourself.
  • You accept the risk, and you'll revoke the permission if you stop trusting the recipient.

Enabling Remote Control is your agreement to this section. It's off by default and is never turned on without a deliberate action by you. We don't monitor remote sessions and we're not responsible for what a person you've authorised does with the access. Don't enable it on a phone holding data you're not entitled to disclose.

8. Marketplace Rentals

Rented devices stay PocketProxy's property. You get exclusive use of the device's proxy connections for the term you chose. You don't get the phone, and you can't see its screen.

Terms are daily, weekly or monthly, and the price is shown before you claim. A rental renews automatically at the end of each term, paid from your account balance, until it ends. Section 10 explains how to stop it.

If your balance can't cover a renewal, the rental ends and the device returns to the marketplace. We don't hold it for you.

You can get a full refund to your balance within 1 hour of claiming a device. After that, the term you've paid for is non-refundable.

We may swap the phone behind a rental, change its IP address, move it between relays, or withdraw it for maintenance or because of abuse. If we withdraw a rental early for a reason that isn't your fault, we'll credit the unused part of the term to your balance.

You're solely responsible for all traffic sent through a rented device.

9. Plans, Prices and Your Balance

Paid features are sold as plans on a device and as marketplace rentals. Prices are in U.S. dollars and shown before you buy. We may change prices. A price change to a renewing plan takes effect at your next renewal after at least 30 days' notice by email.

Balance. You can add funds to your account balance with a card or cryptocurrency. Balance is a prepayment for the Service: it has no cash value, can't be withdrawn or transferred, and isn't refundable except where these Terms or the law say otherwise. Credits we add (refunds to balance, referral commissions, goodwill credits) are balance too. Balance doesn't expire while your account is open. It's forfeited if we close your account for breach.

Card payments are processed by Stripe under Stripe's terms, and cryptocurrency payments by NOWPayments under theirs. We never see or store your card number. Taxes are your responsibility unless we're required to collect them.

Discount codes. A code is one use per purchase unless it says otherwise, may be limited to one customer, and can be changed or withdrawn at any time. Codes used fraudulently are void and we may reverse the discount.

10. Automatic Renewal

Device plans. Auto-Renew is on when you buy a plan for a device, and the price, the renewal period and how to turn it off are shown next to the button before you pay. While it's on, at the end of each plan period we charge the same plan at the then-current price, from your balance first and then from your saved card if the balance is short, until you switch it off. A discount code applies to the first period only. A free plan we grant you doesn't renew unless you switch Auto-Renew on yourself.

Turn Auto-Renew off at any time with the switch on the device's Plan tab. It covers every port on that device, the current period runs to its end, and nothing further is charged while it stays off.

Marketplace rentals. Auto-Renew is on when you claim a rental, and while it's on the rental renews from your balance at the end of each term. To stop a rental, switch Auto-Renew off on the device's Plan tab, or message us at [email protected] or on Telegram, before the renewal time, and the rental ends when the current term ends. A rental also ends on its own when your balance can't cover the next term.

Every charge and renewal is listed on your Billing page with its date and amount, and you can remove a saved card there at any time.

11. Refunds and Chargebacks

  • Marketplace claims: a full refund to your balance within 1 hour of claiming (Section 8).
  • Device plans: if you delete a device that still has paid plan time, the unused part is credited to your balance, pro-rated by day and capped at what you paid.
  • Everything else is non-refundable unless the law requires a refund: balance top-ups, partial terms, and time a device was offline. We may give goodwill credits at our discretion.

Refunds go to your balance, not to your card, unless the law requires otherwise.

Chargebacks. If you dispute a charge with your bank instead of contacting us, we may suspend your account and every service on it immediately, and your balance is held until the dispute is resolved. Contact us first: we fix billing mistakes.

12. Free Trials

A new account gets a 48-hour trial window after verifying its email. During that window one trial connection can run for 24 hours at no charge. One trial per person. We can limit, change or withdraw trials at any time, a trial connection carries no guarantee of availability, and trial traffic is subject to Section 4 like everything else.

13. Devices Without a Plan

A paired device whose plans have all lapsed is removed from the platform after 7 days. A paired device that was never provisioned is removed after 30 days. Removal deletes the device's connections and settings on our side. Your phone and the app on it aren't affected. Delete devices you no longer use.

14. Referral Program

If someone signs up through your referral link, we credit your balance with 10% of the plan payments and renewals they make while they remain a customer. Commission is balance credit, not cash. It's reversed if the referred payment is refunded or charged back.

Referring yourself, your own other accounts, or people you're paying to sign up is abuse: we may void the commissions and close the accounts involved. We may change or end the program at any time. Commissions already credited stay on your balance.

15. API Access

The API is part of the Service and everything sent through it is your use of the Service under these Terms. API keys are credentials you must keep secret. Keys may be rate-limited, restricted to particular devices, and revoked if they're abused or leaked.

16. Intellectual Property

The Service, including its software, apps, design, logos and documentation, belongs to PocketProxy and is protected by intellectual property law. You get a limited, non-exclusive, non-transferable licence to use it under these Terms. You may not copy, modify, reverse engineer, or make derivative works of it, and you may not use our name or logos without written permission.

You keep whatever rights you have in data you send through the Service. You give us only the rights we need to carry it and to operate the Service.

Copyright complaints go to our designated agent. How to send one, how a customer can answer one, and how we treat repeat infringers are on the Copyright Policy page, which is part of these Terms. We close the accounts of repeat infringers in appropriate circumstances.

17. Third-Party Services and Websites

The Service relies on Stripe and NOWPayments for payments, Google for optional sign-in, and mobile carriers for connectivity. Each has its own terms. Websites and services you reach through the Service decide for themselves what traffic they accept. If a site blocks, rate-limits or bans a mobile IP, that's between you and the site.

18. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT ANY IP ADDRESS, CARRIER OR LOCATION WILL BE AVAILABLE, OR THAT ANY THIRD-PARTY SITE WILL ACCEPT YOUR TRAFFIC. SOME JURISDICTIONS DON'T ALLOW THESE EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.

19. Limitation of Liability

TO THE FULLEST EXTENT THE LAW ALLOWS, POCKETPROXY AND ITS OWNERS, EMPLOYEES AND CONTRACTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR USE, ARISING FROM OR RELATED TO THE SERVICE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE'VE BEEN TOLD SUCH DAMAGES ARE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.

20. Indemnification

You'll defend, indemnify and hold harmless PocketProxy and its owners, employees, contractors and agents from any claim, demand, loss, liability, damage and expense (including reasonable legal fees) arising from your use of the Service, the traffic sent through your ports, devices or keys, your breach of these Terms, or your violation of any law or of anyone's rights. We may take over the defence of any matter you're indemnifying us for, and you'll cooperate.

21. Term and Termination

These Terms apply for as long as you have an account. You can close your account at any time from the Account and Data Deletion page.

We may suspend or close your account, or any part of the Service, at any time for breach of these Terms, because of an abuse complaint, because a carrier, law or court requires it, or if we stop offering the Service. For any other reason we'll give you 30 days' notice by email.

When your account closes, access ends, your devices and connections are removed from the platform, and your balance is handled under Section 9. Sections that by their nature should survive do survive, including Sections 16, 18, 19, 20 and 22.

22. Governing Law and Disputes

Governing law. These Terms and any dispute between you and PocketProxy are governed by the laws of the State of Florida, without regard to its conflict of laws rules. The Federal Arbitration Act governs the arbitration agreement below.

Talk to us first. Before starting any formal proceeding, email [email protected] with "Dispute" in the subject line, your account email, and what you want. We'll do the same to you. If we haven't resolved it within 30 days, either of us may proceed as set out below.

Arbitration. Any dispute, claim or controversy arising from or relating to these Terms or the Service that isn't resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator can award the same relief a court could, to you individually. Hearings take place by video conference or, if in person, in Florida. For claims under $10,000 we'll pay the AAA filing fee unless the arbitrator finds the claim frivolous. Judgment on the award may be entered in any court with jurisdiction.

Exceptions. Either of us may bring an individual claim in small claims court instead, and either of us may go to court for an injunction to stop infringement of intellectual property or unauthorised access to the Service.

No class actions. YOU AND POCKETPROXY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable for a particular claim, that claim goes to court, not to class arbitration.

Opting out. You can opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms, with your account email and "Arbitration opt-out" in the subject. Opting out doesn't affect anything else in these Terms.

Court. Any dispute that isn't subject to arbitration will be brought only in the state or federal courts located in Florida, and you consent to their jurisdiction. YOU AND POCKETPROXY EACH WAIVE THE RIGHT TO A JURY TRIAL.

Time limit. To the extent the law allows, any claim relating to the Service must be filed within one year after it arises or it's permanently barred.

23. Sanctions and Export Controls

You confirm you're not located in, and won't use the Service from or for, any country or territory subject to comprehensive U.S. sanctions, and that you're not on any U.S. government list of prohibited or restricted parties. You'll comply with all applicable export control and sanctions laws when using the Service.

24. Changes to These Terms

We may change these Terms. For material changes we'll email the address on your account at least 14 days before they take effect, and we'll post the updated Terms here with a new "Last updated" date. If you don't agree with a change, close your account before it takes effect. Using the Service after the effective date means you accept the change.

25. General

These Terms, with the Privacy Policy, are the whole agreement between you and PocketProxy about the Service. If any part is found unenforceable, it's limited to the minimum extent necessary and the rest stays in force. If we don't enforce a provision, we haven't waived it. You can't assign these Terms; we can assign them to a successor of the business. Neither of us is liable for delays caused by events outside our reasonable control, such as carrier outages, power failures, natural disasters or government action. Notices to you go to your account email. There are no third-party beneficiaries. Headings are for convenience only.

Changes to This Document

  • September 18, 2026: added copyright infringement to acceptable use and linked the new Copyright Policy with its repeat-infringer rule; described Auto-Renew as it works, on by default for bought plans, balance before card, and switched off for the whole device; named NOWPayments for cryptocurrency payments. For accounts opened before September 18, 2026, these changes take effect on October 5, 2026, after the 14 days' email notice Section 24 promises. Same day: named Sunny Vision Investments LLC as the company that runs PocketProxy and added its postal address, and made the Auto-Renew switch on the device's Plan tab stop marketplace rentals too, so you can end one yourself instead of writing to us.
  • September 8, 2026: rewrote the Terms to cover marketplace rentals, account balance, automatic renewal, refunds, trials, the referral program and the API; expanded acceptable use and our enforcement rights; named Florida law and AAA arbitration with an opt-out; added sanctions, chargeback and change-notice clauses.
  • July 25, 2026: added the Device Sharing and Remote Control section.
