Copyright Policy

PocketProxy respects copyright and expects its customers to do the same. This page explains how to tell us about infringement involving the Service under the Digital Millennium Copyright Act (DMCA), how a customer can respond, and what happens to accounts that infringe repeatedly. It's part of our Terms of Service.

What we can and can't take down

Almost everything that passes through PocketProxy is traffic between a customer and some other website. We don't host that content, so we can't delete it from the site it lives on. What we can do is act on the customer: suspend the port, device or account the traffic came from. We also host a small amount of content ourselves, such as device names and marketplace listings, and that we can remove.

Sending a copyright notice

Send a written notice to our designated agent, below. It has to include:

  • A physical or electronic signature of the copyright owner, or of someone authorised to act for them.
  • The copyrighted work you say is being infringed. If there are several, a representative list is enough.
  • The infringing material or activity, with enough detail for us to find it. For traffic through our network that means the proxy IP address and port, the date and time with the time zone, and the URL or destination involved. Without the IP address and the time we can't tell which customer it was.
  • Your name, postal address, phone number and email address.
  • A statement that you have a good faith belief that the use isn't authorised by the copyright owner, its agent or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you're the owner or authorised to act for the owner.

Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material or activity is infringing can be liable for damages. If you're not sure whether something infringes, talk to a lawyer before you send a notice.

Email is fastest. Notices that are missing the items above may not be acted on, and we'll tell you what's missing if we can.

If a notice named you: counter-notices

When we act on a notice we tell the customer, where we can. If you think it was a mistake, send our agent a counter-notice that includes:

  • Your physical or electronic signature.
  • What was removed or disabled, and where it was before we acted: the port, device or account, or the listing.
  • A statement, under penalty of perjury, that you have a good faith belief it was removed or disabled by mistake or because the material was misidentified.
  • Your name, postal address and phone number.
  • A statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if you're outside the United States, any district where PocketProxy can be found), and that you'll accept service of process from the person who sent the original notice.

We'll send a copy to the person who filed the original notice. Unless they tell us within 10 business days that they've filed a court action to stop the activity, we'll restore what we removed or disabled within 10 to 14 business days of getting your counter-notice. False statements in a counter-notice can make you liable for damages too.

Repeat infringers

We keep a record of the valid notices we get against each account. In appropriate circumstances we close the accounts of customers who infringe repeatedly, and we can act on the first notice when the infringement is deliberate or serious. A notice that's withdrawn, or that a counter-notice successfully answers, doesn't count. Closing an account for repeat infringement doesn't come with a refund, as Section 5 of the Terms explains.
